1. Who we are and acceptance

SARBERT Imports ("SARBERT Imports", "we", "us", "our") operates this platform (the "Platform"). By creating an account, booking a session, making a payment, or otherwise using the Platform, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Platform.

2. What we provide — information and guidance only

SARBERT Imports provides general information and guidance about importing goods, together with access to supplier/marketplace contact details. To be clear about what we are and are not:

  • We provide general information and guidance only. We do not provide education, training, tuition, certification, or any qualification.
  • We do not provide professional, financial, investment, legal, tax, accounting, insurance, or customs/clearing advice.
  • We are not an importer, freight forwarder, shipping line, sourcing agent, clearing/customs agent, or broker. We do not buy, source, inspect, ship, insure, or clear any goods on your behalf.
  • You remain at all times the importer and decision-maker, and are solely responsible for your own purchases, suppliers, shipments, payments, taxes, duties, licences, and legal compliance.

Any information we share is general in nature, may not be complete, current, or suitable for your circumstances, and must not be relied on as professional advice. Obtain your own independent, licensed professional advice before acting.

3. No guarantee of results

Importing carries commercial risk. We do not guarantee any profit, income, savings, business success, supplier performance, or other outcome. Any examples or figures are illustrative only. You act on the information and guidance entirely at your own risk.

4. Guidance sessions and bookings

Guidance sessions are delivered online (for example, via Google Meet) at scheduled times shown in East Africa Time (EAT). Bookings are subject to availability and are confirmed once payment is completed. You are responsible for having a suitable device, internet connection, and environment to join, and for keeping your contact details accurate.

5. Payments and pricing

Prices are shown in Kenya Shillings (KES) and are payable in advance unless stated otherwise. We accept M-Pesa and card payments processed by Paystack; we do not store your full card details. We may change prices and offers at any time; the price shown at booking applies to that booking. You are responsible for any taxes applicable to you, and receipts are issued electronically.

6. Refunds, cancellations and rescheduling

  • Rescheduling: you may request to reschedule a booked session up to one (1) hour before its start time, subject to availability and our approval.
  • No-shows: if you do not attend and did not reschedule in time, the session is treated as delivered and the fee is non-refundable.
  • Cancellations by you: handled as stated at the time of booking or in a separate refund policy.
  • Cancellations or failures by us: if we cancel or cannot deliver a session due to our fault, we will offer a free reschedule or a refund for that session.

7. Suppliers and the marketplace (third parties)

The Platform may give you access to supplier and marketplace contact information. Suppliers and other third parties are independent of SARBERT Imports. We do not own, control, endorse, or vet their ongoing conduct. Any enquiry, order, payment, or transaction you make with a supplier or third party is strictly between you and them. We are not responsible or liable for their products, quality, delivery, conduct, misrepresentation, fraud, non-performance, or any dispute or loss arising from your dealings with them. You are responsible for your own due diligence before dealing with, or paying, any supplier.

8. Accounts and acceptable use

You must provide accurate information, keep your login credentials and any two-factor authentication secure, and are responsible for all activity under your account. You must not misuse the Platform, attempt unauthorised access, disrupt the service, use it unlawfully, or infringe others' rights. We may suspend or terminate accounts for breach or suspected unlawful or harmful activity.

9. Intellectual property

The Platform and all content, materials, branding, and software are owned by SARBERT Imports or its licensors. You may not copy, record, screen-capture, republish, resell, distribute, or create derivative works from our sessions, materials, or content without our prior written permission.

10. Third-party services

The Platform relies on third-party services (including Safaricom M-Pesa, Paystack, and Google Meet). We are not responsible for the availability, performance, acts, or omissions of these third parties, and their own terms may apply to you.

11. Disclaimer of warranties

The Platform, the information and guidance, and all sessions are provided on an "as is" and "as available" basis, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted or error-free, or that any information is accurate, complete, or fit for your purpose.

12. Limitation of liability

To the fullest extent permitted by law, SARBERT Imports is not liable for any indirect, incidental, special, or consequential loss, or loss of profit, revenue, goods, data, or business, arising from your use of the Platform, the information and guidance, or your dealings with suppliers or third parties. Our total aggregate liability for any claim is limited to the amount you paid us for the specific service giving rise to the claim in the three (3) months preceding the claim. Nothing here excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless SARBERT Imports, its owners, and staff from any claims, losses, liabilities, and expenses arising from your use of the Platform, your imports or business activities, your dealings with suppliers or third parties, or your breach of these terms.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including internet or power outages, failures of third-party services (such as M-Pesa, Paystack, or Google), acts of government, or other force majeure events.

15. Data protection

We process personal data in accordance with our Privacy Policy and the Data Protection Act, 2019 (Kenya).

16. Changes to these terms

We may update these terms from time to time. The "Last updated" date shows the latest version. Continued use of the Platform after changes take effect constitutes acceptance of the updated terms.

17. Governing law and disputes

These terms are governed by the laws of Kenya. You agree first to contact us to resolve any dispute in good faith. Any dispute that cannot be resolved is subject to the exclusive jurisdiction of the courts of Kenya (Nairobi).
